Terms of Service

By accessing or using the LeadXprt website (leadxprt.com) or any of our services, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the Terms, you may not access the service. These Terms apply to all visitors, users, and others who access or use the service.

LeadXprt provides digital marketing, lead generation, consultation, and related services targeted at small and medium-sized businesses (SMBs) and Real Estate professionals. Services may include but are not limited to:

• Digital marketing strategy and campaign management
• Lead generation and nurturing programs
• Website design and development for Real Estate and SMBs
• Search Engine Optimization (SEO) and content marketing
• Social media management and advertising
• Marketing consultation and business growth advisory
• Analytics reporting and performance tracking

We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice.

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring that your account information remains accurate and up to date

We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

All pricing for our services will be clearly communicated prior to engagement. By engaging our services, you agree to the following:

• Fees are due as specified in your service agreement or invoice
• All fees are non-refundable unless otherwise stated in writing
• We reserve the right to change our pricing with 30 days' notice
• Late payments may incur interest charges as specified in your service agreement
• You are responsible for all applicable taxes

The LeadXprt name, logo, website, and all content, features, and functionality (including but not limited to text, graphics, images, and software) are owned by LeadXprt and are protected by applicable intellectual property laws.

Upon full payment for services, you will own the deliverables created specifically for you under a project agreement, excluding any pre-existing materials, tools, or third-party components. We retain the right to display our work in our portfolio unless otherwise agreed in writing.

By submitting content through our platform, you grant LeadXprt a non-exclusive, royalty-free license to use, store, and process that content solely to provide our services. You agree NOT to:

• Upload or transmit viruses or any other malicious code
• Attempt to gain unauthorized access to any part of our service
• Engage in any conduct that restricts or inhibits anyone's use of the service
• Reproduce, duplicate, copy, sell, or exploit any portion of the service without written permission
• Use the service for any illegal or unauthorized purpose
• Spam, solicit, or harass other users

Both parties agree to maintain the confidentiality of proprietary information shared during the course of the engagement. We will not disclose your business strategies, client data, or other confidential information to third parties without your consent, except as required by law.

The services are provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied. LeadXprt does not warrant that:

• The service will be uninterrupted, timely, secure, or error-free
• Specific marketing results or revenue targets will be achieved
• The quality of any services, information, or other material obtained through the service will meet your expectations

Marketing results depend on many variables outside our control, including market conditions, competition, budget, and your business's responsiveness.

To the maximum extent permitted by applicable law, LeadXprt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising out of or in connection with your use of our services, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount paid by you for the services in the three months preceding the claim.

You agree to defend, indemnify, and hold harmless LeadXprt and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use of the service; (b) your violation of these Terms; or (c) your violation of any third-party rights.

Either party may terminate the service agreement with 30 days' written notice. We may terminate or suspend your account immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the service ceases immediately. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration.

We reserve the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes by email or by posting a notice on our website. Your continued use of the service after changes take effect constitutes acceptance of the revised Terms.
